1. Information We Collect

We collect the following categories of information when you enroll in and use SmileFund:

• Identification information — your name, date of birth, mailing address, email address, and mobile phone number, provided by you and your dental practice during enrollment.
• Payment information — your payment method (credit/debit card or bank account information) is collected and stored by Stripe, Inc., our third-party payment processor. We do not store full card numbers on our systems.
• Plan information — the financed amount, installment schedule, and payment history for your SmileFund payment plan.
• Communication metadata — records of email and SMS messages we send to you in connection with your plan, including delivery status, opens, clicks, and any opt-out signals you provide (e.g., replying STOP, clicking an unsubscribe link).
• Server logs — when you visit pages on SmileFund-operated websites, we may log standard request metadata (IP address, user agent, timestamps) for security and operational purposes.

SmileFund is a financing service and does not collect or store dental clinical records or protected health information.

2. How We Use Information

We use the information described above to:

• Service your SmileFund payment plan and process your scheduled installments.
• Send you transactional account messages by email and SMS (payment reminders, failed-payment notices, collection notices, signing links).
• Coordinate with the dental practice that enrolled you in the SmileFund payment plan.
• Operate, maintain, secure, and improve the Service.
• Comply with applicable legal obligations.

We do not use your information to send marketing or promotional messages, and we do not sell your personal information to third parties.

3. How We Share Information

We share information with the following categories of recipients, only to the extent necessary to operate the Service:

• Your dental practice — the practice that enrolled you in the SmileFund payment plan receives information necessary to administer your plan and reconcile payments.
• Stripe, Inc.— our payment processor receives payment-method information and transaction details necessary to process your installments. Stripe's privacy practices are governed by its own privacy policy.
• Twilio Inc. and SendGrid (Twilio) — our SMS and email service providers receive the information necessary to deliver transactional messages to you.
• Service providers — vendors that provide hosting, infrastructure, analytics, security, and customer-support services to JGX DIGITAL LAB LLC, under written agreements that restrict their use of the information.
• Legal and safety — we may disclose information if required by law, legal process, or to protect the rights, property, or safety of JGX DIGITAL LAB LLC, our users, or others.

4. SMS Consent and Opt-Out

Patient consent to receive SMS and email messages from JGX DIGITAL LAB LLC is obtained in person, in writing, at the patient's dental practice at the time the patient enrolls in a SmileFund payment plan, as part of the signed financing agreement. We do not share, sell, or transfer SMS opt-in data or mobile phone numbers to third parties for the purpose of sending marketing messages, and any consent given for SMS messages is used solely for transactional account messages related to your SmileFund payment plan. You may opt out of SMS messages at any time by replying STOP to any SmileFund text message, and you may opt out of email messages by clicking the unsubscribe link at the bottom of any SmileFund email.

5. Data Retention

We retain personal information for as long as is necessary to service your payment plan, comply with applicable legal and tax obligations, resolve disputes, and enforce our agreements. Communication metadata may be retained for legitimate operational and compliance purposes.

6. Security

JGX DIGITAL LAB LLC maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No method of electronic transmission or storage, however, is fully secure, and we cannot guarantee absolute security.

7. Your Rights

Depending on where you reside, you may have certain rights regarding your personal information, including the right to access, correct, or delete personal information that we hold about you, and the right to opt out of certain uses of your information. To exercise these rights, contact us using the information below. We will respond consistent with applicable law.

8. Children

SmileFund is not directed to children under 18. We do not knowingly enroll patients under 18 in payment plans, and we do not knowingly collect personal information from children under 18. If you believe a minor has provided personal information to us, contact us and we will take steps to delete the information.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or SMS to the contact information on file and update the effective date above. We encourage you to review this Policy periodically.
